Wilmar, LLC (“Wilmar, LLC,” “we,” or “us”) respect the privacy of our customers and visitors and are committed to protecting it through our compliance with this policy.

This policy describes the types of information we collect from you or that you may provide when you visit our website (the “Site”) and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies to information we collect: (1) on this Site; and (2) in email, text, and other electronic correspondence between you and this Site or Wilmar, LLC. This policy does not apply to information collected by us offline or through other means, including through any third part, and it does not apply to any third party website or applications.

Information Collection

In the course of business we may collect some or all of the following information about customers or prospective customers: first and last name, e-mail address, country, area code, telephone, username, password, company name, company address, company city, state and zip code, time zone, language, shipping address and/or billing address. Credit card information may be collected if our products or services are purchased over the Internet. All financial information you enter on our Site is encrypted with Secure Sockets Layer (SSL) technology which encodes the information before it is transmitted to us. The SSL technology decodes the data after it reaches our server to help ensure that there is no unauthorized access to your information while it is transmitted. Once data reaches our site, it is protected by the same state-of-the-art security we use to protect our company's essential business data.

We may also collect information that is about you individually, but does not identify you, such as your IP address, how you use the Site, or information related to your computer system.

We collect this information: (1) directly from you when you provided it to us; and (2) automatically as you navigate the Site. Automatically collected information includes usage details, your IP address, and any information collected through cookies. The information we collect may include, but is not limited to: (1) information you provide to us by filling out forms on our Site or when you report a problem with the Site; (2) records and/or copies of your correspondence if you contact us; and (3) details of transactions you carry out through out Site and of the fulfillment of your orders.

Information We Collect Through Automatic Data Collection Technologies As you navigate through and interact with our Site, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns that are saved in our logs, including:

  • Date of access, time, IP address (from), user name (account user), site name (internal), computer name (server), IP address (server), port (server), method request type (put, head, get), URI stem (URL), URI query, status (return code from request), WIN32 status, SC bytes, CS bytes, time taken, version, host, user agent, cookie, referring site.

Information about your computer and internet connection, including your IP address, operating system, and browser type. We do not associate this information with personal information we collect in other ways or receive from third parties. We use this information to improve our Site and to deliver a better service to you by enabling us to estimate our audience size and usage patterns, store information about customer preferences, speed up searches, and in some cases recognizes guests when they return to our Site.

Information Use
We use information that we collect about you or that you provide us, including personal information:

  • To fulfill any other purpose for which you provide it.

  • To fulfill the purpose for which you provide it. For example, if you provide us with a shipping address when placing an order for our products, we will use that shipping address to ship you the products you ordered.

We do not sell, rent or share for consideration, any customer information or data that we collect on our site

Guests who visit our site may be identified using “cookies”. A cookie is data stored on the user's hard drive that contains information about the user. Usage of a cookie is not linked to any personally identifiable information while on our site. Once you close your browser, the cookie terminates. Cookies enable us to track and target the interests of our users to enhance their experience on our site. We have no control over cookies that are used by the sites you may link to from our site. All information collected on the our web site properties is stored and maintained in a secure facility that limits access to authorized personnel only. All Wilmar, LLC employees are informed about the company's privacy policy and security policies on a routine basis. Our web site properties are regularly audited and tested for security breaches to ensure all collected information is secure from unauthorized access and viewing.

 

Children Under the Age of 18
Our Site is not intended for children under 18 years of age. No one under age 18 may provided any information on our through our Site. We do not knowingly collect personal information from children under 18. If you are under 18, do not use or provide any information on this Site. If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information. If we change our privacy policy, we will post notification of the changes on our Home Page so our web site visitors are always aware of what information we collect, how we use it, and under what circumstances we disclose it, if any. We only make these business purpose disclosures under written contracts that describe the purposes, require the recipient to keep the personal information confidential, and prohibit using the disclosed information for any purpose except performing the contract. Your Rights and Choices
The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

 

Right to Know and Data Portability
You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months (the "right to know"). Once we receive your request and confirm your identity (see Exercising Your Rights to Know or Delete), we will disclose to you:
  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting or selling that personal information.

Right to Delete
You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions (the "right to delete"). Once we receive your request and confirm your identity (see Exercising Your Rights to Know or Delete), we will review your request to see if an exception allowing us to retain the information applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:
  1. Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.
  2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  3. Debug products to identify and repair errors that impair existing intended functionality.
  4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
  6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
  7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  8. Comply with a legal obligation.
  9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
Exercising Your Rights to Know or Delete
To exercise your rights to know or delete described above, please submit a request by either:
  • Emailing us at tools@wilmarcorp.com.
  • Logging into your account and making the request through there.

Only you, or someone legally authorized to act on your behalf, may make a request to know or delete related to your personal information.

You may only submit a request to know twice within a 12-month period. Your request to know or delete must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative, which may include:
    • Responding to our request that you confirm at least two pieces of information already in our possession; or
    • Logging into your account on our Site.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

You do not need to create an account with us to submit a request to know or delete. However, we do consider requests made through your password protected account sufficiently verified when the request relates to personal information associated with that specific account.

We will only use personal information provided in the request to verify the requestor's identity or authority to make it.

Response Timing and Format

We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the 10-day timeframe, please contact us at tools@wilmarcorp.com.

We endeavor to substantively respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:
  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information's value and contain written terms that describe the program's material aspects. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time.
